Program: EXPUNGEMENT/CLEARING CRIMINAL RECORD

Description

Accepts requests for expungement (clearing a criminal record) and assists with this process. To expunge a criminal record, the person must submit a document with the court and ask the Judge to remove the guilty plea and dismiss the case. The guilty plea is then changed to "dismissed". Expungement requests can be submitted for both misdemeanor and felony convictions and will be assessed for eligibility.

Free Expungement Clinic at Oxnard College Swap Meet

As part of Swap Meet Justice, the Public Defender's Office hosts a free expungement clinic the last Sunday of each month at the Oxnard Swap Meet (located near the gym). Services include:

  • Volunteer attorneys from the Public Defenders' office help applicants dismiss misdemeanors convictions that are eligible for mandatory expungement without a hearing
  • For issues that require a hearing, such as certain felonies that can qualify for reductions, volunteer attorneys will explain the process of getting the matter referred to the Public Defenders office
  • Assist in understanding if a conviction is eligible for expungement
  • Immigration attorneys offer advice about how a criminal record might affect immigration status

Eligibility

-In most cases the Court requires that the outstanding balance on the case has been paid off
-Must have completed Probation
-Must not have other pending cases
-Must follow all of the terms of the sentence
-If the case is a felony, the case must be eligible for an expungement

Misdemeanor expungement: Submit the forms available at https://vcpublicdefender.org/misdemeanor-expungements/ or call for paralegal assistance.

Felony expungement: Submit an online application through https://vcpublicdefender.org/felony-expungement/
